Vapesells Affiliate Programme Terms

1. General Provisions of the Affiliate Programme

Vapesells is operated by JACQUELYNANN CREATIVE LIMITED, a private limited company registered in Northern Ireland under company number NI725403.

By registering for the affiliate programme of the Vapesells online shop (the “Programme”), operating at www.vapesells.com, you agree to these Affiliate Terms (the “Terms of Use”). The Vapesells affiliate programme enables website owners, bloggers, content creators, and people interested in e-cigarettes to earn commission by recommending products from our e-cigarette shop, including disposable e-cigarettes, e-liquids, vape liquids, pods, and vape accessories.

Vapesells reserves the right to update or change these Affiliate Terms at any time without prior notice. Any new features that improve or extend the Programme, including new tools, advertising materials, or resources, are subject to these Terms. Continued use of the Programme after a change constitutes acceptance of the updated Affiliate Terms.

If these Terms are breached, the affiliate account will be deleted and any unpaid commission earned during the breach will be reversed. You agree to use the Programme at your own risk and to be responsible for content published when promoting e-cigarettes.

2. Conditions for Participation

To participate in the Vapesells affiliate programme, you must meet the following conditions:

– You must be at least 18 years old, because promotion of e-cigarettes and nicotine-containing products is intended only for adults.

– You must live in Europe or conduct business related to the European market because the Programme is intended for partners in the region.

– You must be an individual or entity legally entitled to enter into contracts. Registrations made by automated systems or bots are prohibited.

– You must provide your full name, a valid email address, and any other information needed to complete registration.

– Login details for the affiliate panel may be used by only one person. Sharing login details with more than one person is prohibited.

– You are responsible for the security of your account and password. Vapesells is not responsible for damage resulting from a breach of security rules.

You are responsible for everything you publish as part of a promotion and for activity performed through your affiliate profile. You may not use the Programme for illegal or unauthorised purposes, and you may not breach local law, including rules concerning copyright and advertising of nicotine-containing products.

3. Affiliate Links and Advertising Materials

After joining the affiliate programme, you will receive a unique affiliate link. You may place affiliate links, banners, or graphic materials containing your affiliate code on your website, in emails, or in other messages. We provide link guidance, styles, and graphics to help promote Vapesells.

To ensure accurate tracking and commission calculations, we provide special link formats that must be used for links between your website and vapesells.com. Links that correctly use these formats are called “Special Links”. You will receive commission only for sales completed through purchases of Vapesells products using these special affiliate links.

We may change the design of graphic materials at any time, but we will not change their dimensions without prior notice. The affiliate must use only current advertising materials supplied by Vapesells.

4. Rules for Promoting E-Cigarettes

Because of the nature of the e-cigarette industry and applicable European and local rules on advertising nicotine-containing products, the affiliate must follow these promotional rules:

– Advertising for e-cigarettes, e-liquids, and vape accessories must be directed only to adults who are at least 18 years old.

– The affiliate may not direct promotional content to minors or publish it in media intended for children or young people.

– Promotional content may not contain false information about e-cigarettes, including untrue claims about health effects.

– The affiliate may not claim that e-cigarettes are safe or help people stop smoking without scientific evidence.

– All promotional content must comply with the Vapesells Terms and Conditions and Age Policy.

5. Commissions and Payments

To earn commission, products must be purchased through your unique affiliate link. Commission is paid only for links tracked and recorded by our system. Commission will not be paid for purchases that were not correctly tracked, including purchases made directly on vapesells.com without clicking an affiliate link.

Payments will be made when your commission exceeds the established minimum threshold. If an affiliate profile does not reach the threshold, commission will not be paid during that settlement period and will carry over to the next period. Details of commission rates, payment thresholds, and settlement dates are provided in the affiliate panel.

An affiliate may not purchase products for personal use through their own affiliate links in order to earn commission. This will be treated as a breach of the Affiliate Terms and may result in account deletion.

6. Presenting the Vapesells Brand

You may not publish press releases or claim to be an official partner or representative of Vapesells unless you have received explicit written permission. You may not misrepresent your relationship with Vapesells or suggest that you are authorised to make decisions on behalf of the shop.

The affiliate must present the Vapesells brand accurately and truthfully. Vapesells trademarks, logos, and graphic materials may not be used in a way that suggests a false partnership or authorisation.

7. Compliance with Law

Participation in the affiliate programme depends on accepting and complying with all applicable laws, regulations, and legal standards relating to marketing, electronic communication, personal-data protection (GDPR), and advertising of nicotine-containing products. The affiliate must follow rules on sending marketing messages, including obtaining recipients’ consent to communication.

If applicable law is breached, Vapesells may immediately terminate the affiliate agreement and delete the account without a notice period.

8. Duration and Termination

This affiliate agreement takes effect when your application is accepted and remains in force until terminated by either party. Either party may terminate the agreement at any time without giving a reason by notifying the other party in writing, including electronically.

Vapesells may end the affiliate programme at any time. When the Programme ends, the affiliate must remove all links and advertising materials from their website and stop using our trademarks and logos.

9. Liability and Limitation of Liability

We are not responsible for indirect, special, or consequential loss connected with this agreement or the affiliate programme, including loss of profit, data, or benefits. Our total liability may not exceed the total commission paid to the affiliate under this agreement.

Vapesells does not guarantee a minimum number of sales or amount of commission. The affiliate’s financial results depend on promotional activity, content quality, and engagement in promoting e-cigarettes.

10. Final Provisions

All disputes connected with this affiliate agreement will be resolved under applicable European and local law. Matters not governed by these Terms are governed by the relevant provisions of the applicable civil law.
